Practice Note 9 - Use of Artificial Intelligence

1. Purpose

This Practice Note outlines the expectations and procedures for the use of generative artificial intelligence (“AI”) in filings in proceedings before the Saskatchewan Labour Relations Board (the “Board”).  The Board has noticed an increase in filings that appear to use AI and wants to clarify its expectations in receiving these filings.

The Board is aware of the issues of potential hallucination of legal authorities and information by AI: see for example Reddy v Saroya, 2025 ABCA 322 (CanLII) at paras 73-84; Agyeman (dba Learn and Drive Academy) v. Hosseinzadmoghadasi, 2025 BCCRT 1278 (CanLII) at para 11;A2501051 (Re), 2025 CanLII 97422 (BC WCAT) at paras 17-20; Simpson v. Hung Long Enterprises Inc., 2025 BCCRT 525 (CanLII) at paras 21-26; and Zhang v Chen, 2024 BCSC 285 (CanLII). In order to promote and maintain the integrity and credibility of Board proceedings, the Board urges caution in the use of AI and requires the disclosure of the use of AI in proceedings before it. 

2. Statement of Use

If a party or an intervenor has used AI in the creation or preparation of materials submitted to the Board, those materials must contain a statement at the end of the document that AI was used in the preparation.

3. Confirmation of Veracity

A party or intervenor that uses AI is required to confirm the veracity and accuracy of any information contained in submissions created or prepared with AI.  This includes confirming any referenced legal authorities.

There must be meaningful human involvement in the review and verification of AI generated materials prior to the filing of the same with the Board.

In terms of the verification of legal references in AI generated materials, references can be confirmed through sources such as:

4. Board Discretion

The Board retains discretion to determine the admissibility of any document, including a document generated in whole or in part by AI.  The Board may seek particulars about the source of any materials or information filed with the Board.
