Board Resolutions Delegating Powers to Executive Officer

Resolution of the Saskatchewan Labour Relations Board:

BE IT RESOLVED THAT, pursuant to Section 4(12) of The Trade Union Act, R.S.S. 1978, c. T-17, as amended, the Saskatchewan Labour Relations Board delegates to the Executive Officer the following powers or functions:

  1. Pursuant to sections 5, 5.1, 5.2, 12, 16, 18, 19, 24, 25.1, 26.5, 37, 37.3, 42 and 43 of The Trade Union Act, with respect to any application or application for an interim order, to determine and to make orders as to any procedural matters or issues including, without limiting the generality of the foregoing, the amendment of any application, reply or other process of the Board, orders respecting the disclosure of information, the provision of particulars, the production of documents, the order of presentation of evidence, the adjournment or continuation of a hearing.

  2. To appoint, as the Executive Officer may deem necessary or advisable, an agent of the Board in any application or application for an interim order where it is within the jurisdiction of the Board to do so.

  3. To direct that a vote be taken by secret ballot of all employees eligible to vote pursuant to Section 6 of The Trade Union Act and to provide direction as to the conduct of the said vote and any matters necessarily incidental thereto, including without limiting the generality of the foregoing, to determine the employees eligible to vote, to determine the time and place where the said vote shall be conducted, to determine the form of the ballot, and/or the procedures to be utilized in the event of dispute as to eligibility of employees to vote, and to appoint an agent of the Board to oversee the conduct of the vote and perform the duties of Returning officer. Provided, however, that any employer, employee or trade union affected by any act done by the Executive Officer in the exercise or purported exercised of any such delegated power or function, may apply to the Board to review, set aside, amend, stay or otherwise deal with the impugned act and the Board upon the application or, of its own motion, may exercise its powers or perform its functions with respect to the matter in issue as if the Executive Officer had not done such act.
